Terms And Conditions for 'Monitor Pack' to ISRIA ("The Service")

The Monitor Pack (The Service) is an online information service from ISRIA SARL ("ISRIA"). By using the Service, ("the Subscriber") you agree to the Terms and Conditions for an Monitor Pack. Please read the Terms and Conditions carefully. ISRIA may revise the terms in this Agreement at any time. By using the Service after any change in the Agreement is posted, you agree to be bound by all of the changes.

The Subscriber is responsible for complying with the Terms and Conditions. Any violation of the Terms and Conditions may jeopardize future use of the Service, and upon any such violation, such account may be subject to immediate suspension or termination by ISRIA as determined in its sole discretion.

Section 1. Copyright And Limitations On

1.1 Under the terms of an Monitor Pack, access to ISRIA content, services or tools, and other intelligence features is for the Subscriber ONLY and may not be shared. The Subscriber is responsible for the confidentiality and use of the Subscriber's user name and personal password. The Subscriber's responsibility extends to all activity and use under the user name and password. By purchasing the Monitor Pack, you agree not to reproduce, retransmit, photocopy, distribute, disseminate, sell, publish, broadcast, or circulate the information received through the Service to anyone without the express prior written consent of ISRIA. Information abstracted from our intelligence can be used for research purposes but not for commercial purposes. Copying and distributing original copyright-protected intelligence from the site is expressly forbidden.

1.2 The Subscriber agrees to provide complete and accurate account information. It is the sole responsibility of the Subscriber to report any changes to ISRIA Customer Service department immediately. Further, if it is determined that the information provided is inaccurate or incomplete, ISRIA reserves the right to suspend or terminate the account until such information is corrected by the Subscriber.

1.3 The information available through the Service is the property of ISRIA or its licensors, and is protected by copyright and other intellectual property laws. Information received through the Service is for the Subscriber's use only. Only 'Individuals' and 'Corporate Accounts' of Corporations, enterprises, organizations or other commercial entities are authorized to use the Monitor Pack Service under these Terms and Conditions. However, Multiple Corporate Accounts also are bound by these terms of use except if special terms have been defined by a written agreement between ISRIA and specific Corporations, enterprises, organizations or other commercial entities.

1.4 Subscribers may not post any intelligence from the Service to newsgroups, mail lists, or electronic bulletin boards, without the prior written consent of ISRIA.

1.5 ISRIA reserves the right to monitor the Subscriber's use of all intelligence, services, and tools to ensure the Subscriber's compliance with the Terms and Conditions. If it is determined that the Subscriber is not in compliance with these Terms and Conditions, ISRIA reserves the right to take such action as is deemed necessary, including, but not limited to, suspension or termination of the Subscriber's account. The Subscriber acknowledges that such monitoring of use may include determining whether or not the Service is accessed under the account from multiple IP addresses, as well as noting excessive use from Monitor Pack accounts.

1.6 The Service includes facts, views, opinions, and recommendations of individuals and organizations deemed of interest. ISRIA does not guarantee the accuracy, completeness, or timeliness of, or otherwise endorse, these views, opinions, or recommendations, give investment advice, or advocate the purchase or sale of any security or investment.

Section 2. Disclaimer Of Warranties And Liability

2.1 Due to the number of sources from which information on the Service is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions, or inaccuracies in such information and the Service.

2.2 ISRIA SARL AND ITS AFFILIATES, AGENTS, AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE NEWS AND INFORMATION AVAILABLE THROUGH THE SERVICE, OR THE SERVICE ITSELF. NEITHER ISRIA NOR ANY OF ITS AFFILIATES, AGENTS, OR LICENSORS SHALL BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY LOSS OR INJURY CAUSED IN WHOLE OR IN PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING, COMPILING, INTERPRETING, REPORTING, OR DELIVERING THE SERVICE AND ANY NEWS AND INFORMATION THROUGH THE SERVICE. IN NO EVENT WILL ISRIA, ITS AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO THE SUBSCRIBER OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY THE SUBSCRIBER IN RELIANCE ON SUCH INFORMATION, OR FOR ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SUBSCRIBER AGREES THAT THE LIABILITY OF ISRIA, ITS AFFILIATES, AGENTS, AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE), IN ANY WAY CONNECTED WITH THE SERVICE OR THE INFORMATION IN THE SERVICE, SHALL NOT EXCEED THE AMOUNT THE SUBSCRIBER PAID TO ISRIA FOR USE OF THE SERVICE.

2.3 ISRIA may discontinue or change the Service, or its availability, at any time without notice. The Subscriber's rights and obligations under this Agreement are not assignable. If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect. This Agreement, all intellectual property issues, and your rights and obligations shall be governed by the laws of France and international laws.

Section 3. Payment Policies

3.1 Monitor Pack -- Free Trial

One can ask for a free trial period (via this page) during which the user can partly or fully access the service. Login information following a request for a free trial is strictly personal. Any multiple use or sharing of such information would lead to immediate account's termination; without mentioning legal consequences.

3.2 Monitor Pack -- General:

You understand that you are purchasing a risk-free membership to ISRIA's Monitor Pack and agree to the terms of use. You also understand that your credit card will be charged at the end of any trial period and your membership will be automatically renewed unless your contact customer service to cancel.

3.3 Monitor Pack -- Annual Subscription:

Accounts are prepaid on an annual basis and may be paid by credit card only (except for multiple accounts). Activation begins upon payment. Unless otherwise notified by ISRIA, your credit card account will be automatically charged each year on the anniversary of your subscription. At that time, you will be renewed at the then current rate, unless you notify us of your desire to cancel your subscription at least thirty (30) days prior to the renewal date.

3.4 Monitor Pack - Individual Subscription:

Indidivual means that you subscribe for personal purpose only. An individual email address is required. Using professional email address is not possible.

Section 4. Cancellation Policies

4.1 If a subscription is active, it's active for at least 12 months from the moment you subscribed. Then, to cancel your Monitor Pack, you notify us of your desire to cancel your subscription at least thirty (30) days prior to the renewal date for annual subscription or at least ten (10) days prior to the renewal date for quarterly subscription by sending an email entitled “Subscription Cancellation Request” to contact@isria.info. Please be sure to provide your name, address, phone number, e-mail address, user name and password for authentication, and the reason you want to cancel. Cancellations are processed upon receipt of the cancellation request.

4.2 Monitor Pack -- Annual subscription: Upon cancellation, annual accounts will be charged only for the year of service during which the account was active. All fees and charges are nonrefundable for an annual subscription.

4.3 Monitor Pack -- Quaterly subscription: Upon cancellation, annual accounts will be charged only for the quarter (3 months) of service during which the account was active. All fees and charges are nonrefundable for a quarterly subscription.

Section 5. Privacy Policy

5.1 ISRIA is committed to protecting your privacy. Information that we collect stays within ISRIA and any information distributed to third parties is reported in aggregate only. We do not give or sell your information. For more information, please read the full text of our Privacy Policy.
